Calcutta HC Declares Social Boycott "Uncivilized Practice", Calls for Strict Administrative Action

In a landmark decision the Calcutta High Court condemned social boycott as an "uncivilized practice" and emphasized the state administration's responsibility to deal with it strictly. Justice Jay Sengupta's ruling comes in response to a case where a man faced ostracism for reporting illegal construction near his property.


The court reiterated the fundamental right to life and dignity guaranteed under Article 21 of the Indian Constitution, highlighting that social boycott violates this right by isolating and ostracizing individuals.

Justice Sengupta called the practice "unacceptable in a civilized society" and declared that it has no place in a modern democracy.

He directed the state administration and police to maintain vigilant patrols and take strict action against anyone involved in imposing or causing social boycott.

The court further ordered the authorities to offer necessary protection to the petitioner and ensure his right to live peacefully in his community.


Justice Sengupta stated, "Social boycott is an uncivilized practice that has no place in a society governed by the rule of law. It infringes upon the fundamental right to life and dignity of individuals and cannot be tolerated." He further warned, "The state administration must act swiftly and decisively against anyone found practicing or abetting social boycott. Strict action is necessary to deter such malicious practices and protect the rights of all citizens."


The verdict encourages individuals to seek legal intervention and resist the pressure of social boycott, knowing they have legal protection and state support.
